المستخلص: نظرا لأهمية المشروعات المقامة بنظام الـ B.O.T وامتدادها لمدد طويلة فإن الدولة المضيفة تتبع مجموعة من الإجراءات التي تراها ضرورية ولازمة لاختيار الشركة التي سوف تقوم بإنشاء المشروع وتشغيله، وعلى ذلك تبدأ الدولة المضيفة بتحديد المشروعات والمرافق التي تحتاج إليها بصورة ملحة، ثم تقوم بعد ذلك بعمل دراسة الجدوى المبدئية للمشروع وأعداد كراسة الشروط متضمنة المواصفات الفنية ومعايير الجودة المطلوبة، ثم تقوم بالإعلان عن المناقصة وتلقى العروض المختلفة والتي تدخل في مفاوضات أفضلها للوصول إلى أفضل الشروط تحقيقا للمصلحة العامة، وأخيرا تنتهي هذه المرحلة بإبرام العقد مع الشركة التي رسا عليها العطاء ونجحت معهم المفاوضات وفقا للقواعد والإجراءات التي وضعها المشرع. وعلى هدى ما تقدم فقد تم تقسيم هذا البحث إلى ثلاث مباحث: خصصنا المبحث الأول: الإجراءات السابقة على التعاقد بنظام الـ B.O.T وتناولنا في المبحث الثاني: تنفيذ عقد B.O.T. واستعرضنا في المبحث الثالث: طرق تنفيذ عقود الـــ B.O.T.

In view of the importance of projects established by the B.O.T system and their extension for long periods, the host country follows a set of procedures that it deems necessary and necessary to choose the company that will establish and operate the project, and accordingly the host country begins by identifying the projects and facilities that it urgently needs, and then takes action The initial feasibility study of the project and the preparation of the specifications document, including the required technical specifications and quality standards, then you announce the tender and receive the various offers, which enter into negotiations for the best of them to reach the best conditions in order to achieve the public interest, and finally this stage ends with the conclusion of the contract with the company that won the bid and the negotiations succeeded with them According to the rules and procedures set by the legislator. Based on the above, this research has been divided into three sections: We devoted the first topic: the procedures prior to contracting with the B.O.T system, and we dealt in the second topic: the implementation of the B.O.T contract. In the third topic, we reviewed: Methods of implementing B.O.T contracts.
