|a شكل الاعتقال الاحتياطي ولا زال أحد المشاكل الشائكة المطروحة باستمرار في النظام الجنائي وخاصة على مستوى مسطرة التحقيق الإعدادي، والأكيد أن السبب لا يكمن في الاعتقال الاحتياطي ذاته وإنما يكمن أساسا فيما يترتب عن هذا الأخير من آثار سلبية ومساوئ كونه من أشد الإجراءات مساسا بالحرية بل وأكثرها تعارضا مع قرينة البراءة أصبحت الحاجة ملحة للبحث عن بدائل أكثر نجاعة وحداثة من شأنها أن تساهم في تحقيق ذلك وهو ما حاول المشرع المغربي تكريسه من خلال مشرع قانون المسطرة الجنائية الجديد ومشرع قانون 43.22 المتعلق بالعقوبات البديلة الذي نص كل منهما على نظام الوضع تحت المراقبة الإلكترونية كآلية أو صلاحية جديدة خلال مرحلة التحقيق الإعدادي.
|b Preventive detention remains a persistent and contentious issue within the criminal justice system, particularly concerning the pre-trial investigation procedure. The root of the problem does not lie solely in preventive detention itself but rather in the negative consequences and drawbacks associated with it, as it is one of the most restrictive measures on individual freedom and often contradicts the presumption of innocence. There is an urgent need to explore more effective and modern alternatives that can contribute to achieving these goals. The Moroccan legislature has attempted to address this by enacting the new Criminal Procedure Code and Law 43.22 on alternative sanctions, both of which introduce electronic monitoring as a mechanism or a new authority during the pre-trial investigation phase.
