المستخلص: من أبرز مظاهر التطور الهائل والسريع للحياة المعاصرة التطور الصناعي، فبات هناك زيادة واضحة في إنتاج السلع كما ونوعا وانتشارها على نطاق واسع عبر المبادلات التجارية بين الدول، فقد كان قديما المنتوج البسيط خاليا من العيوب والأضرار جل مكوناته مواد أولية وخامات طبيعية، إلا أنه بهذا المفهوم البسيط ومع تطور المدنية بات عاجزا عن تلبية حاجات الأفراد، مما دعت ضرورة الحاجة والعصرنة إلى إنتاج سلع معقدة التركيب يعجز الفرد العادي عن استيعاب مكوناتها في ظل ما يعرف بالإنتاج المكثف حيث يكون هناك ملايين النسخ للمنتوج الواحد، وبهذا اختفي مفهوم المنتج العادي وحل محله الشركات الصناعية الضخمة التي في سبيل تحقيق زيادة معتبرة في الأرباح، وزيادة حجم المبيعات باتت لا تراعي في منتوجاتها مقاييس الجودة العالية والنوعية الرفيعة، ومقاييس الأمان، فأصبحت هذه المنتوجات تهدد أمن وصحة وسلامة المستهلك، فلا يقتصر ضرر هذه المنتجات على الأشخاص أو كسب فائت على شخص واحد بل يمتد إلى الآلاف، كما لا يمس ضررها الخسارة المادية فقط، بل يمتد إلى أقصى من ذلك وهي حياة الإنسان، وهذا ما يؤكد بصورة واضحة وملحة إلى أهمية تحديد نطاق المسؤولية المدنية للمنتج، لتبيان حدودها أمام المضرور.

Thus, the concept of the ordinary product disappeared and was replaced by large industrial companies that, in order to achieve a significant increase in profits and increase the volume of sales, began to avoid taking into consideration high-quality standards and safety standards in their products. Therefore, these products threaten the security, health and safety of the consumer. These products do not harm only a few people or cause a loss of profits to one person; instead, these harms extend to thousands. Their harm does not only affect material loss but extends to a greater extent than that, which is human life. This clearly and urgently confirms the importance of defining the scope of civil liability for the producer in order to clarify its limits before the injured party.
