المستخلص: إن وظيفة الضبط الإداري من أقدم الوظائف التي اضطلعت بها الدولة منذ التاريخ القديم، وتعد وظيفة إدارية ولازمة لحماية لمجتمع ووقاية النظام العام أن الدولة في الوقت الحاضر تتدخل في مجالات النشاط الفردي، وذلك نتيجة لواقع الضغط الاقتصادي والاجتماعي وغيرها، وتنعكس ممارسة الإدارة لوظيفة الضبط الإداري على الحريات العامة للأفراد ولوجود صلة وثيقة بين الضبط الإداري والحريات العامة عند ممارسة الأفراد لحرياتهم العامة، وقد يحدث أخلال بالنظام العام أو تهديد ذلك وعند تدخل سلطات الضبط الإداري لحماية النظام العام يؤدي إلى المساس بحريات الأفراد بصورة أو بأخرى، ويتمثل هذا المساس في قيام سلطات الضبط الإداري بفرض قيود عديدة على ممارسة الأفراد لحرياتهم، وعلى مما ذكرناه فإن هنالك ضمانات عديدة للحريات العامة في مواجهة سلطات الضبط الإداري مثل الرقابة القضائية محور الضمانات لتحديد مدى مسؤولية الإدارة عن أعمالها الضبطية.

The function of administrative control is one of the oldest functions undertaken by the state since ancient history, and it is an administrative function necessary to protect society and protect public order. The state at present intervenes in areas of individual activity, as a result of the reality of economic, social and other pressure, and the administration’s exercise of the function of administrative control is reflected in Public freedoms of individuals and the existence of a close link between administrative control and public freedoms, when individuals exercise their public freedoms, and a disturbance of public order may occur or a threat to that, and when the intervention of administrative control authorities to protect public order leads to the infringement of the freedoms of individuals in one way or another, and this infringement is represented by the establishment of the control authorities The administrative system imposes many restrictions on individuals exercising their freedoms. Based on what we mentioned, there are many guarantees for public freedoms in the face of administrative control authorities, such as judicial oversight, the focus of the guarantees to determine the extent of the administration’s responsibility for its control actions.
