|a إن وظيفة الضبط الإداري من أقدم الوظائف التي اضطلعت بها الدولة منذ التاريخ القديم، وتعد وظيفة إدارية ولازمة لحماية لمجتمع ووقاية النظام العام أن الدولة في الوقت الحاضر تتدخل في مجالات النشاط الفردي، وذلك نتيجة لواقع الضغط الاقتصادي والاجتماعي وغيرها، وتنعكس ممارسة الإدارة لوظيفة الضبط الإداري على الحريات العامة للأفراد ولوجود صلة وثيقة بين الضبط الإداري والحريات العامة عند ممارسة الأفراد لحرياتهم العامة، وقد يحدث أخلال بالنظام العام أو تهديد ذلك وعند تدخل سلطات الضبط الإداري لحماية النظام العام يؤدي إلى المساس بحريات الأفراد بصورة أو بأخرى، ويتمثل هذا المساس في قيام سلطات الضبط الإداري بفرض قيود عديدة على ممارسة الأفراد لحرياتهم، وعلى مما ذكرناه فإن هنالك ضمانات عديدة للحريات العامة في مواجهة سلطات الضبط الإداري مثل الرقابة القضائية محور الضمانات لتحديد مدى مسؤولية الإدارة عن أعمالها الضبطية.

Based on what we mentioned, there are many guarantees for public freedoms in the face of administrative control authorities, such as judicial oversight, the focus of the guarantees to determine the extent of the administration’s responsibility for its control actions.
