|a تكمن أهمية بحثنا هذا في كونه يبين موضوع الاختصاص التشريعي ومن هي السلطة المختصة باقتراح مشاريع القوانين، وما ينهض عن ذلك من إشكاليات حول انتهاك مبدأ الفصل بين السلطات وما هي أبرز القيود على السلطتين التنفيذية والتشريعية في هذا المجال علاوة عن دور القضاء الدستوري في إرساء متطلبات الدولة القانونية وما يزيد من أهمية الدراسة عدم اقتصارها على الجانب النظري، بل أن للدراسة جانباً تطبيقياً عملياً تمثل في التركيز على القرارات الصادرة من المحكمة الاتحادية العليا وتحليلها
