|a يعد قانون المرافعات المدنية والتجارية هو القانون العام للإجراءات القضائية وغير القضائية (أي التي لا تتصل بخصومة قائمة أمام القضاء) بمعنى أنه يتعين الرجوع إليه إذا شاب القوانين الإجرائية الأخرى نقص أو غموض أو إبهام. - ومن ناحية أخرى، إذا خلا قانون المرافعات من نص خاص في مسألة ما فليس ثمة ما يمنع من تطبيق نص إجرائي أخر متي كان المقصود من هذا النص هو مجرد التبسيط والتيسير. وقد كان من أهم النتائج التقدم العلمي في الآونة الأخيرة لا سيما في وسائل التواصل الاجتماعي أن العالم أصبح قرية صغيرة، ومن ثم ضرورة التخصص في كافة المجالات، لأن الممارس العام لم يعد يفيد، الأمر الذي دفع المشرع المصري إلى ضرورة إصدار القانون رقم ۱۲ لسنة ۲۰۰۸ الخاص بإنشاء المحاكم الاقتصادية والقانون رقم 1 لسنة ۲۰۰۰ الخاص بإنشاء محاكم الأسرة.
