يعد الأجر أحد عناصر عقد الشغل الأساسية، ويحظى في نظر الأجير بأهمية بالغة لما له من دور معيشي واقتصادي لا تستقيم حياة الأجير بدونه، لذا كان من اللازم إقرار حماية قانونية صارمة تستجيب لحاجة هذا الأخير الملحة للحصول على أجر قار يكفل له ولأسرته العيش الكريم، وفي إطار أداء الأجر قد حدد المشرع المغربي بعض الوسائل التي من خلالها يعتبر الأجير قد توصل بأجره وهي ورقة الأداء، ودفتر الأداء، وفي ظل التطور التكنلوجي أصبح الأجر يعرف متغيرات على مستوى أدائه باعتماد وسائل حديثة رقمية تساهم في اختصار عنصر الزمان والمكان، لكن يبقى الإشكال المطروح على مستوى الإثبات بهذه الوسائل في ظل التحول الرقمي الذي أصبحت تشهده كل نواحي الحياة البشرية، هو كيف حاول القضاء التعامل مع النزاعات المطروحة في إطار الإثبات الرقمي للوفاء بالأجر، خاصة وأن هناك فئة عريضة من الطبقة العاملة وحتى بعض المشغلين لم يسايروا إلى حد الآن عصر التعامل الرقمي، ولذلك اخترت هذا الموضوع ليكون محل دراسة لهذه الإشكالية.
