|a يحقق اختيار موضوع البحث "شرط الثبات التشريعي في عقود الاستثمار الأجنبي في سلطنة عمان" فائدة عملية تتمثل في أنه يهتم بدراسة وتحليل موضوع يعد من الموضوعات المهمة في السلطنة؛ على اعتباره أهم محددات مناخ الاستثمار الأجنبي، ويلعب دوراً محورياً لدى المستثمر الأجنبي عند اتخاذ قراره باختيار السلطنة دولة مضيفة لاستثماراته. تتمثل أهمية البحث في أنه يعالج موضوعاً في غاية الأهمية وفي أحدث قوانين الاستثمارات الأجنبية؛ ليستظهر مدى كفاية نصوصه في المسألة المحاطة بالبحث. جاء هذا البحث للوقوف على أهم الإشكاليات التي تتمثل في أن المشرع العماني قد منح المستثمر الأجنبي العديد من المزايا والحوافز والضمانات في القانون الجديد، لكنه في المقابل رهن الاستفادة من بعضها بصدور قرار من مجلس الوزراء (كما هو حال منح مزايا إضافية)، والبعض الآخر بصدور أحكام من الهيئة بالتنسيق مع الجهات المعنية الأخرى (كتقرير حق انتفاع طويل المدة) والبعض الثالث ربط الاستفادة من هذه الحوافز بأحكام قانون ساري (كقانون الضريبة على الدخل)، بينما لم يتضمن النص الصريح على خضوع عقد الاستثمار للقوانين واللوائح والقرارات السارية في السلطنة وقت إبرام العقد. ويثير هذا الوضع بلا شك مخاوف وقلق المستثمر الأجنبي؛ مما يؤدي إلى تراجع نسبة الاستثمار في السلطنة بدلاً من مضاعفتها. وقد لا يحقق رؤية السلطنة في الوصول إلى نسبة الاستثمار إلى (10%) عشرة في المائة من الناتج المحلي الإجمالي. فما هو الحل لتجنب هذه النتائج غير المقبولة، وما هو السبيل في تحقيق أحد أهم مؤشرات رؤية السلطنة؟ هذا ما يحاول الإجابة عليه.
|b A practical advantage of selecting " The Legislative Stability Clause in Foreign direct investment (FDI) Contracts in Oman” as the research topic is that it concentrates on analyzing and examining a major issue connected with foreign investment in Oman. It is also very important to foreign investors when deciding whether to choose the Sultanate as the location of their investments. The research topic is significant because it addresses current foreign investment regulations, proving their applicability in the area of the research. The most significant issues found in this research are that the new law passed by the Omani legislators offers numerous benefits, incentives, and assurances to international investors. The investor's capacity to benefit from these incentives and guarantees, however, is subject to the approval of the Council of Ministers (as is the case when granting additional benefits) and the regulations that the Authority issues in conjunction with other pertinent bodies (e.g. determining a long-term usufruct right). Moreover, a few other parties link these incentives' benefits to specific legal requirements (such as the Income Tax Law). The fact that the investment contract is governed by the rules, laws, and regulations that are in force in the Sultanate at the time of contract conclusion is not made explicit. Without a doubt, this circumstance generates questions about foreign investors, which causes investment in the Sultanate to drop rather than rise. It's possible that the Sultanate's goal of achieving a 10% GDP investment rate won't be realized. How can we prevent these unsatisfactory outcomes and how can we attain one of the most significant markers of the Sultanate's vision? This study aims to provide an answer to it.
