|a تتناول هذه الورقة قضية استقلال القضاء في نظام ما بعد عام 2013 في مصر، وتبحث في العلاقة بين السلطتين التنفيذية والقضائية وتداعيات ذلك على النزاهة القضائية وتحقيق العدالة. وتحلل التشريعات والمواد الدستورية التي تنظم القضاء، ثم تتناول بالتفصيل التعديلات التي طرأت عليها منذ عام 2013 من خلال تحليل المعوقات الرئيسة لاستقلال القضاء، ومنها توسيع اختصاص القضاء العسكري، ومحاكمة القضاة المعارضين للحكومة، وعدم قدرة القضاء على حماية السيادة المصرية. وتقترح جملة من التوصيات لإصلاح السلطة القضائية، منها إعادة تشكيل مجلس القضاء الأعلى، وبناء قواعد واضحة للمساءلة والتأديب، فضلا عن تحديد شروط عادلة لتعيين القضاة.

It specifically analyses the dynamics between the executive and the judiciary, highlighting the consequences on judicial integrity and justice. The analysis focuses on the constitutional legislation that governs the judiciary, subsequently delving into revisions made to this legislation since 2013. It explores the primary impediments to the independence of the judiciary, encompassing the increasing scope of the military judiciary's authority, the prosecution of judges who express dissent towards the government, and the court's incapacity to safeguard Egyptian sovereignty. The paper presents several ideas aimed at reforming the judiciary, including the restructuring of the Supreme Judicial Council, the establishment of transparent accountability and disciplinary regulations, and the implementation of equitable criteria for the recruitment of judges.
