|a تتناول هذه المقالة دور مؤسسة وسيط المملكة في تعزيز الحكامة الارتفاقية على مستوى الجماعات الترابية في المغرب. حيث يتم تسليط الضوء على الاختلالات التي تشوب تدبير هذه الوحدات الترابية، لا سيما في قطاعات التعمير، تنفيذ الأحكام القضائية، الطلبيات العمومية والموارد البشرية. ويقارن المقال بين خصوصيات تدخل مؤسسة الوسيط والقضاء الإداري في معالجة هذه القضايا، مبرزا مميزات المسطرة المتبعة لدى هذه المؤسسة من حيث البساطة والسرعة والفعالية والشفافية. كما تستعرض هذه الدراسة حصيلة وآفاق عمل وسيط المملكة في مجال الجماعات الترابية، مسلطة الضوء على أهم التوصيات والمقترحات الكفيلة بتجاوز الإكراهات وتعزيز الحكامة الجيدة على المستوى الترابي، بما في ذلك تفعيل مبدأ التدبير الحر، وإشراك المواطن في صنع القرار، وتبني سياسة القرب، والارتقاء بجودة الخدمات المقدمة.
|b This article examines the role of the Kingdom Mediator in promoting easement governance at the level of territorial collectivities in Morocco. The imbalances in the management of these territorial units are highlighted, especially in the sectors of construction, execution of judicial rulings, public orders and human resources. The article compares the peculiarities of the intervention of the mediator institution and the administrative judiciary in dealing with these cases, highlighting the advantages of the procedure followed by this institution in terms of simplicity, speed, effectiveness and transparency. This study also reviews the outcome and prospects of the work of the Kingdom's mediator in the field of territorial communities, highlighting the most important recommendations and proposals to overcome constraints and promote good governance at the territorial level, including activating the principle of free management, involving citizens in decision-making, adopting a policy of proximity, and improving the quality of services provided.
