|a تصوب هذه الورقة تحليلها نحو الإحاطة بتاريخ التشريعات الاستعمارية الفرنسية في الجزائر، ويتعلق الأمر بالمنظومة القانونية الاستثنائية المطبقة خلال الحقبة الكولونيالية ومدى تأثيراتها على الجزائريين، على أن تكون دراستنا منصبة حول قانون السلطات الخاصة 1956م في الجزائر من حيث الملامح والأبعاد والنتائج، وضمن إطار منهجي يعتمد على أسلوب البحث الوصفي التاريخي، تتوصل الدراسة إلى أن قانون السلطات الخاصة قد اعتمدته حكومات باريس المتعاقبة كإطار تشريعي لتبرير جرائمها في الجزائر خلال الثورة التحريرية بالتحديد، وتطبيق سياسات إصلاحية منافية تماما لمطالب الجزائريين وطموحاتهم، كما تهدف الدراسة إلى تبيان الاستخدام الممنهج لشتى وسائل وأساليب القمع والردع من قبل الجيش الفرنسي ضد الجزائريين، خلافا لماء جاء في القانون الفرنسي العادي ومناهضة بذلك المواثيق الدولية لحماية حقوق الإنسان.
|b This paper aims its analysis towards understanding the history of French colonial legislation in Algeria, and it is related to the exceptional legal system applied during the colonial era and the extent of its effects on Algerians, provided that our study is focused on the Special Powers Law of 1956 AD in Algeria in terms of features, dimensions and results, and within a methodological framework that relies on The historical descriptive research method, the study concludes that the special powers law was adopted by the successive governments of Paris as a legislative framework to justify their crimes in Algeria during the liberation revolution in particular, and the application of reform policies that are completely contrary to the demands and aspirations of Algerians. The study also aims to demonstrate the systematic use of various means and methods of repression and deterrence from The French army accepted against the Algerians, contrary to what came in the ordinary French law and against the international covenants for the protection of human rights.
