المستخلص: يهدف البحث إلى الاعتناء بأحكام المعادن النفيسة على اختلاف أنواعها، نظرا لأهميتها في حياة الناس وكونها من المرتكزات الأساسية التي يقوم عليها الاقتصاد العالمي عامة، والإسلامي خاصة، وفق منهج استقرائي تحليلي استنباطي مقارن، لتظهر بها عظمة التشريع الإسلامي وشموليته ومراعاته لأحوال الناس، مما يؤدي إلى إسعادهم بجلب المصالح لهم ودرء المفاسد عنهم. احتوت الدراسة على بيان ماهية المعادن النفيسة وأوجه الفرق بينها، ومعرفة خواصها الكيميائية؛ لما لها من أثر فقهي في بعض النماذج التطبيقية المعاصرة على سبيل التمثيل لا الحصر، والمتعلقة بباب الزكاة وباب الحظر والإباحة. توصلت الدراسة إلى نتائج عدة، تمثلت في إبراز وجوه الاختلاف والتنوع في ماهية المعادن النفيسة وأثرها في بعض الفروع الفقهية بما يحقق مقاصد الشريعة الإسلامية، بنظرة استدلالية عميقة تتميز بإبراز مرونة الشريعة وإيفائها لكل متطلبات العصر، وذلك من خلال التمييز بين أنواع المعادن المختلفة وتطبيق الأحكام الفقهية من حيث تزكيتها وكيفيتها وحكم استعمالها. توصي الدراسة مراعاة الفقهاء والمفتين للاختلافات في ماهية المعادن النفيسة في تعليمهم وإفتاءاتهم. كما توصي الباحثين وطلبة العلم بالتوسع في البحث والدراسة في جميع المسائل والفروع الفقهية التي لم تتناولها الدراسات البحثية بعد والتي يؤثر في حكمها اختلاف الماهية للمعادن النفيسة.

The research paper aims to take care of the provisions of precious metals of all kinds, given their importance in people's lives and being one of the basic pillars upon which the global economy in general and Islamic economy in particular are based, according to an inductive, analytical, deductive and comparative approach, to show the greatness and comprehensiveness of Islamic legislation and its consideration of people's conditions, which leads to make them happy by bringing their interests and warding off evils from them. The study describes the nature of precious metals, the differences between them, and their chemical properties due to their jurisprudential impact on some contemporary applied models, for example, and their relation to the chapter on zakat and the chapter on prohibition and permissibility. The study reached several results, represented in highlighting the differences and diversity in the nature of precious metals and their impact on some branches of jurisprudence in order to achieve the purposes of Islamic Sharia, with a deep inferential view characterized by highlighting the flexibility of Sharia and its fulfillment of all the requirements of the age, by distinguishing between different types of metals and the application of jurisprudence provisions. The study recommends that jurists and muftis take into account the differences in the nature of precious metals in their education and fatwas. It also recommends researchers and students to expand research and study in all issues and branches of jurisprudence that have not yet been addressed by research studies and whose judgment affects the different nature of precious metals.
