|a يتناول هذا البحث الطرق التي يعتمدها الأصولي، لاستنباط علة الحكم الشرعي، وذلك بحصر الأوصاف التي يظن مناسبتها للحكم، بواحدة من طرق الحصر التي ذكرتها في أثناء البحث، ثم يبطل ما لا يكون صالحا منها للتعليل، بواحدة من طرق السبر المذكورة في البحث أيضا، وهذا البحث يساهم في تقليل الفوضى الموجودة في الفتاوى المتعلقة بالمسائل الاجتهادية، إذ أن الناظر في الواقع يلاحظ العشوائية في إطلاق الأحكام بسبب عدم مراعاة طرائق الأصوليين في الاستنباط.
|b This research deals with the methods adopted by the fundamentalist, to deduce the reason for the legal ruling, by listing the descriptions that he thinks are suitable for the ruling, using one of the methods of inventory that I mentioned during the research, and then invalidating what is not suitable for explanation, using one of the methods of investigation mentioned in the research. Also, this research contributes to reducing the chaos that exists in fatwas related to matters of jurisprudence, as the observer actually notices randomness in issuing rulings, due to failure to take into account the methods of fundamentalists in deduction.
