|a لما كانت الأعمال التجارية التي تنشأ بين الأفراد أنفسهم (التجار) سواء أشخاصا طبيعية كانوا أم معنوية وسواء أمحليين (وطنيين) كانوا أم أجانب، فهذه الأعمال وممارستها لابد أن تؤدي في الكثير من الأحيان إلى نشوب نزاعات بينهم، ولما كان القضاء في الوقت الحاضر يلجأ إلى التخصص في نظر هذه النزاعات عبر إنشاء محاكم استثنائية تتولى النظر في نوع معين من القضايا التي تعرض عليها ومن هذه المحاكم المحاكم التجارية التي تتخصص في النظر في المنازعات التجارية لأن هذه الأعمال بدأت تتزايد يوما بعد يوم بسبب تطور الحياة الاقتصادية ومحاولة من الدول إلى دفع عجلة التنمية إلى الأمام. لذلك واستنادا إلى ما تقدم سنحاول أن نبين في هذا الفصل أهم الإجراءات التي يجب اتباعها عند رفع النزاع إلى المحاكم التجارية عبر تقسيم هذا الفصل على مبحثين نتناول في المبحث الأول طرق التقاضي أمام المحاكم التجارية وفي المبحث الثاني تنفيذ الأحكام الصادرة عن هذه المحاكم وكالآتي:
|b Since the commercial activities that a rise between the individuals themselves (merchant), whether natural or legal persons, whether local (national) or foreign, these activities and their practice must often lead to outbreak of disputes between them, and since the judiciary at present resorts to specialization in examining these disputes through the establishment of exceptional courts that consider a specific type of cases presented to them. Among these courts are the commercial courts that specialize in examining commercial disputes because this business has begun to increase day after day due to development of economic life and an attempt by countries to advance the wheel of development. Therefore based on the above, we will try to explain in this search the most important procedures that must be followed when submitting a dispute to the commercial courts. By dividing this chapter into two sections, we will discuss in the first section the methods of litigation before commercial courts, and in the second section the implementation of judgments issued by these courts.
