المستخلص: يتناول هذا البحث الحديث عن إشارة النص وأثرها في تفسير آيات الأحكام، وذلك من خلال بيان المقصود بإشارة النص، ومدى حجية إشارة النص في آيات الأحكام، وكيف وظف العلماء هذا النوع من الدلالة في استنباط الأحكام الشرعية، من خلال الوقوف على بعض الأمثلة والتطبيقات الواردة في بعض آيات الأحكام، وتوصل الباحث إلى جملة من النتائج من أبرزها، حجية إشارة النص تارة تكون قطعية إذا كان الحكم المستنبط واضحا كمسألة نسب الولد لأبيه، والطهارة ليست من شروط صحة الصوم اعتمادا على إشارة النص، وأن الخلاف في ذلك شاذ لا يعول عليه، وتارة أخرى يكون ظنيا إذا كان خفيا محتملا كمسألة الصلاة على الشهيد، وهو رأي محتمل من إشارة النص لا يميل إليه الباحث، وصحة عقد النكاح من غير المهر أو الصداق، وفي ذلك خلاف معتبر، فلا يجزم بإشارة النص، وكل ذلك من خلال نصوص آيات الأحكام والمواضع التي فيها إشارة للنص.

This research deals with the discussion of the textual reference and its effect in interpreting the verses of rulings, by explaining what is meant by the connotations of words according to the majority of fundamentalists and Hanafi scholars, and the extent of the validity of the textual reference according to them, and how scholars have employed this type of connotation in deducing legal rulings, by looking at some examples. And the applications mentioned in some of the verses of the rulings, and the researcher reached a number of results, the most prominent of which is that the validity of the text’s reference is sometimes conclusive if the ruling derived is clear, such as the issue of the lineage of a child to his father. Purity is not one of the conditions for the validity of fasting based on the reference of the text, and the disagreement regarding that is anomalous and unreliable, and at other times it is speculative if it is hidden and possible, such as the issue of praying for the martyr, a possible opinion based on the reference of the text that the researcher does not tend to, and the validity of a marriage contract other than the dowry or dowry. There is considerable disagreement about this, so it is not certain of the text’s reference.
