520 |a من الجوانب المهمة في مسيرة علم الفقه، والتي لها أثر بارز في عملية التقويم والتصحيح والتسديد للبناء الفقهي، الذي شيده الفقهاء- رحمهم الله تعالى- على مر الأعصار، ما يعرف ب (التعقبات)، إذ هي جزء مهم من العملية التتابعية على مر العصور، والهادفة إلى تتميم ما نقص، أو تصحيح ما وقع من خطأ، أو نفي ما حصل من وهم، أو تقييد ما لا يصح إطلاقه، إلى غير ذلك من أهداف التعقب المرجوة منه، وكان العلماء والفقهاء ولا يزالون يستدرك بعضهم على بعض، ويتعقب بعضهم بعضا، مع تمام الأدب، ومعرفة الفضل، وحفظ القدر، وإن من العلماء الراسخين العلامة تقي الدين محمد بن علي القشيري، الشهير ب (ابن دقيق العيد)، شهد له العلماء الأكابر بسعة العلم وغزارته، وجودة ذهنه وفهمه، وهو دقيق النظر غواص على المعاني، ولاستنباطاته وتعقباته واستشكالاته مكانتها العالية، وقد جاء هذا البحث لدراسة تعقباته الفقهية على الحنابلة في باب المياه، وفق منهج يرجى معه الفائدة المتوخاة من دراسة تلك التعقبات بإذن الله تعالى. ومن أبرز ما يهدف إليه هذا البحث: ١- بيان مكانة ابن دقيق العيد العلمية، وإبراز قيمة تعقباته الفقهية على الحنابلة. ٢- إبراز منهج ابن دقيق العيد في تعقباته على الحنابلة، وسماتها. ٣- جمع تعقبات ابن دقيق العيد الفقهية على الحنابلة في باب المياه، ودراستها وفق منهج علمي، يحقق الفائدة المرجوة من دراسة التعقبات بمشيئة الله تعالى وتوفيقه. ٤- تقييم تلك التعقبات وإبداء الرأي فيها، مقرونا بالتعليل والتوجيه. ومن أبرز النتائج لهذا البحث: ١- دقة تعقبات ابن دقيق العيد، واعتنائه ببيان وجه التعقب، وتقريره على أحسن وجه. ٢- جاءت مسائل هذا البحث ثمانيا، تعقب فيها ابن دقيق العيد الحنابلة في اثني عشر موضعا، وافقه الباحث في سبعة مواضع، كما وافقه فيما تعقبه على الحنابلة في ثلاثة مواضع، إلا أنه كان للباحث في تلك المواضع الثلاثة مباحثات وإيرادات، بما يمكن معه أن يدفع ذلك التعقب، ولم يوافق الباحث ابن دقيق العيد فيما تعقبه على الحنابلة- مطلقا- في موضعين، أوضح فيهما سبب ذلك. ومن توصيات هذا البحث: ١- العناية بتعقبات العلماء عموما، والفقهاء خصوصا، إذ هي تبرز الجانب التقويمي والتصحيحي في مسيرة العلم والتصنيف. ٢- العناية بوضع منهج علمي دقيق لدراسة التعقبات، يضمن تحقيق الفوائد العلمية والفقهية المأمولة من دراستها. ٣- العناية بدراسة التعقبات الفقهية للعالم النحرير ابن دقيق العيد، فله العديد من التعقبات في كثير من المسائل على عدد من الفقهاء والمذاهب، لما تتسم به تعقباته من الدقة والعمق.  |b An important aspect of the course of jurisprudence, which has a significant impact on the process of evaluation and correction of the construction of jurisprudence, built by scholars over time, is the so-called (Tracing), so it's an important part of the back-to-back process over the ages, aimed at completing the shortfall, or correcting the error that occurred, or deny any illusion, or restrict what is not permissible to release, Scientists and scholars were still rectifying each other, correcting each other. With the perfection of literature, knowledge of credit, preservation of stature, and distinguished scholars Takhi Din Muhammad bin Ali Al-Qashiri, Known as Ibn Dakeek Al-Eid, scientists witnessed him with abundant science, The quality of mind, which is careful consideration and reflection, and its intrusions and consequences are of high standing And this research came to study the jurisprudence of Ibn Dakeek Al-Eid on the Hanbali doctrine in water matters, In accordance with the curriculum, please consider the usefulness of studying these traces if God willing. One of the main aims of this research is: 1- to demonstrate the scientific status of Ibn Dakeek Al-Eid and to highlight the value of his jurisprudence's consequences on the Hanbali doctrine. 2- Highlight Ibn Dakeek Al-Eid curriculum in its implications for Hanbali doctrine and its features. 3. Collect the jurisprudence traces Ibn Dakeek Al-Eid jurisprudence on the Hanbali doctrine in matters of water, and study them according to a scientific curriculum, achieves the desired benefit of studying the traces with the approval of God Almighty. Evaluating and expressing opinions on those jurisprudence, together with explanation and guidance. One of the main findings of this research is: 1- the accuracy of the jurisprudence of Ibn Dakeek Al-Eid, and his interest in indicating the direction of tracing in the best way. 2- The issues of this research were eight, in which Ibn Dakeek Al-Eid meticulous followed the Hanbali doctrine in twelve places, The researcher agreed with him in seven places, and he agreed with his tracking of the Hanbali doctrine in three places, However, the researcher in those three locations had discussions, with which such tracing could be paid, The researcher disagreed with Ibn Dakeek Al-Eid on the Hanbali doctrine in two locations, where he explained the reason for this. One of the research’s recommendations is: 1- to take care of the jurisprudence of scientists in general, and of jurists in particular, as it identifies the calendar and corrective aspect of the history of science and classification. 2- Take care of the development of a precise scientific curriculum for the study of jurisprudence traces, ensuring the realization of the scientific and intellectual benefits hoped for in the study. 3- Paying attention to studying the jurisprudential corrections of the scholar Ibn Daqiq al-Eid, as he has many corrections on many issues for a number of jurists and schools of thought, due to the accuracy and depth of his words.
