|a ظهرت في الآونة الأخيرة ظاهرة كتابة الأبحاث العلمية عن الغير تبعا لمتطلبات التعليم الحديث، ومستجدات الحياة العلمية والعملية، فلمست وجود الحاجة لتبيين الحكم الشرعي لهذه المسألة، سيما وقد كثر السؤال عنها، فجاء هذا البحث ليتكلم عن الأحكام الفقهية للاستعانة بالغير في إعداد الأبحاث العلمية، ويقتصر مفهوم كلمة "الأبحاث" الواردة في العنوان على ما يتعلق بالأبحاث العلمية التي يقدمها الباحثون في شتى العلوم، أو الطلبة في الجامعات والمدارس، وبذلك فإن هذا البحث لا يشمل ما كان من قبيل نشر العلم الشرعي، أو من قبيل التكليفات التي يكلف بها الطلبة في غير البحث العلمي، كالمساعدة في الواجبات، كما لا يشمل ما كان من قبيل السرقات العلمية، وقد قصدت في هذا البحث ابتداء استقراء الصور التي يمكن أن تدخل في الاستعانة بالغير في إعداد الأبحاث العلمية، مع توضح ذلك بالأمثلة، وسلكت فيه المنهج الاستقرائي، الوصفي، الاستنباطي، وخلصت إلى أنه ليس كل استعانة بالغير في إعداد الأبحاث العلمية تعد محرمة، فهناك من الصور ما يجوز فيها الاستعانة بالغير في إعداد الأبحاث العلمية، كالاستعانة بهم في كتابة البحث حاسوبيا، وهناك من الصور ما تحرم فيها الاستعانة كالاستعانة الكلية بالغير في إعداد الأبحاث العلمية؛ ثم ختمت البحث بذكر الضوابط الحاكمة للاستعانة بالغير في إعداد الأبحاث العلمية.
|b Writing research has become one of the requisites of modern learning, and it is necessary to show the Sharia ruling on the issue of seeking the help of others for writing research. The concept of the word research mentioned in the title is limited to what is related to scientific research presented by researchers in various sciences, or by students at universities and schools. It does not include the field of spreading Islamic knowledge, or daily assignments given to students, such as helping with homework, nor does it include scientific plagiarism. The research aims to extrapolate the forms of seeking others’ assistance to prepare scientific research, and gives clarifying examples, counting on the inductive, descriptive, deductive method. It has been found that not every assistance from others in the preparation of scientific research is prohibited. For example, it is permissible to seek the assistance of others to type the research paper on the computer. On the other hand, it is prohibited according to Sharia to ask someone to make the whole research. Then I concluded the research by mentioning the rules governing the use of help from others in the preparation of scientific research.
