|a من الواضح أن التطور العلمي والتكنولوجي يسير بخطى واسعة الأمر الذي يتطلب ضرورة وجود التشريعات والقوانين التي يمكن أن تتكفل بتنظيمها بالشكل الذي يضاهي هذا التطور العلمي والتكنلوجي لاسيما مع ما تحدثه هذه التطورات من آثار عميقة في العلاقات بين الأفراد داخل المنظومة الاجتماعية، ولعل أهم المستحدثات في هذا العصر هو الذكاء الاصطناعي الذي يتم استثماره في كثير من المجالات ومنها مجال المركبات ذاتية القيادة والتي يمكن أن نسميها بـ (المركبات الذكية) التي تقاد وتسير في الطرقات والمسالك بشكل آلي تماما من دون أي تدخل بشري في قيادتها، ومع النقص التشريعي في معالجة وتنظيم هذه الفئة من المركبات وبالأخص في تحديد المسؤولية المدنية عن الحوادث التي تتسبب بها هذه المركبات فقد ارتأينا أن نخص هذا البحث بتوضيح جوانب ذات أهمية كبيرة بهذه المركبات وبالأخص من الوجهة القانونية، إذ تم توضيح مفهوم المركبات الذكية والمقصود بها وذلك بإلقاء الضوء على تعريفها والتشريعات القليلة التي نظمت هذا النوع من المركبات وكذلك خصائص هذه المركبة وما يميزها عن غيرها من المركبات العادية ومن جانب آخر قمنا بتحديد الأساس القانوني للمسؤولية المدنية للحوادث التي تتسبب بها هذه المركبات وذلك بشقي المسؤولية المدنية سواء العقدية أم التقصيرية ومن ثم تحديد الجهة التي تتحمل هذه بالمسؤولية مستعينين في كل هذا بالآراء الفقهية والتشريعية بهذا الخصوص على ندرتها.
|b It is clear that scientific and technological development is proceeding at a rapid pace, which requires the necessity of legislation and laws that can regulate it in a way that matches this scientific and technological development, especially with the profound effects that these developments have on the relations between individuals within the social system. Perhaps the most important innovations in this era is artificial intelligence, which is being invested in many fields, including the field of self-driving vehicles, which we can call (smart vehicles), which drive and move on roads and paths completely automatically without any human intervention in driving them. Due to the legislative deficiency in dealing with and regulating this category of vehicles, especially in determining the aspects of civil liability for accidents caused by these vehicles, we decided to summarize this research by clarifying aspects of great importance to these vehicles, especially from a legal point of view, as the concept of smart vehicles and what is meant by them were clarified by presenting Shedding light on its definition and the legislation that regulated this type of vehicle, as well as the characteristics of this vehicle and what distinguishes it from other ordinary vehicles. On the other hand, we have determined the legal basis for civil liability for accidents caused by these vehicles, by both sides of civil liability, whether contractual or tortious, and then defining this liability using In all of this, jurisprudential and legislative opinions in this regard, despite their scarcity.
