|a شكلت الوثيقة الدستورية لسنة 2011 إطارا مرجعيا أساسيا للحقوق والحريات الأساسية بحيث عرف المغرب تحولات مهمة في الترسانة القانونية الناظمة للحقوق والحريات، وذلك من خلال الضمانات القانونية والمؤسساتية التي كرستها الوثيقة الدستورية الأخيرة التي اعترفت بحقوق الإنسان بأجيالها الثلاث، وأحدثت مؤسسات وطنية للسهر على احترامها والنهوض بها، ووفرت الضمانات القضائية لحمايتها. بيد أن التنزيل الفعلي للقوانين المتعلقة بكيفيات وشروط ممارسة تلك الحقوق، عرف مجموعة من التقييدات التي حولت شروط ممارسة بعض الحقوق، إلى قيود يصعب معها التمتع بتلك الحقوق. كما أن الوقائع والأحداث التي عرفها المغرب بعد ذلك، والمتمثلة في تنامي المد الاحتجاجي، والمطالب الاجتماعية والاقتصادية والثقافية في سائر أنحاء البلاد، وبروز نوع جديد من نشطاء الإنترنت وموجة الاعتقالات التي طالت مجموعة الصحفيين والمدونيين والمدافعين عن حقوق الإنسان... وضعت السلطة على المحك، بين التوفيق في ضمان ممارسة الحقوق والحريات المكرسة دستوريا، وبين المحافظة على النظام واستتباب الأمن.
|b The 2011 constitutional document provided a fundamental reference framework for fundamental rights and freedoms, marking significant transformations in the legal arsenal governing rights and freedoms in Morocco. This framework was reinforced by the legal and institutional guarantees established by the latest constitutional document, which recognized human rights across their three generations and created national institutions to ensure their respect and promotion, while providing judicial guarantees for their protection. However, the effective implementation of laws relating to the modalities and conditions for exercising these rights encountered a series of restrictions, transforming the conditions for exercising certain rights into obstacles that make it difficult to fully enjoy these rights. Additionally, the events and developments that Morocco experienced afterward such as the rise of protest movements, social, economic, and cultural demands throughout the country, the emergence of a new type of internet activists, and the wave of arrests targeting journalists, bloggers, and human rights defenders... placed the authorities in a difficult position. They are now faced with balancing the guarantee of constitutionally enshrined rights and freedoms with maintaining order and ensuring security.
