|a يهدف البحث إلى تطبيق القواعد الأصولية على الفروع الفقهية، وهو منحصر بالنسبة للقواعد الأصولية المتعلقة بمباحث الحكم الشرعي ومباحث دلالات الألفاظ في باب الطلاق. وقد اشتمل على مقدمة ومبحثين وخاتمة، فكان المبحث الأول في دراسة القواعد الأصولية المتعلقة بمباحث الحكم الشرعي وتطبيقاتها على أحكام الطلاق، ثم المبحث الثاني في القواعد الأصولية المتعلقة بمباحث دلالات الألفاظ وتطبيقاتها على أحكام الطلاق، وتوصل البحث إلى أن فروع الطلاق ومسائله كثيرة منتشرة، وعند تدقيق النظر فيها، يتبين أنها مرتبطة بغالب المباحث الأصولية التي مهدها الأصوليون في كتبهم ، وأن اختلاف الفقهاء في بعض المسائل مبني على اختلاف الأصوليين في القواعد الأصولية التي ترتبط بها الفروع المختلف فيها. وقد استوعب الفقهاء صور الطلاق التي يمكن أن تصدر من المكلفين وأحكامها، وبنوا غالبها على قواعد الأصول بناءً واضحاً؛ كل على حسب مذهبه، مع ارتباط كثير من قواعد الأصول ارتباطا وثيقا بقواعد اللغة العربية.
|b The research explores the Fundamental rules related to divorce rulings: A Fun-damental Study on the issues of the legal ruling and the semantic of words. The re-search aims at applying the fundamentalist rules to the Fiqh branches in the field of divorce, which is limited to the Fiqh ruling and semantics research, and practical proof that the provisions of the Fiqh branches are mostly due to the rules of the ori-gins of jurisprudence. The most important research results: 1) The branches of divorce and many of its issues are widespread, and when scrutinizing them, it turns out that they are related to the fundamentalist investigations, except for the absolute and restricted search from the search of verbal semantics. 2) When the fundamentalist rule is agreed upon, the issues of divorce based on it are often agreed upon among jurists, but some people have another perception that makes them more likely than what the fundamentalist rule requires. 3) Many divorce issues are attracted by several fun-damentalist rules. 4) The difference of Jurists in some branches is based on the difference of fundamentalists in fundamentalist rules.
