|a التقريب هو جمع حكمين لمسألة ما لمعرفة الصالح منهما ثم تغليب أحد الحكمين على الآخر لاعتبار شرعي مرده المصلحة غالبا، والتقريب والتغليب نجده في كثير من العلوم ففي البلاغة والنحو وأصول الفقه وفي القواعد الفقهية، ونجد له تطبيقات كثيره في فروع الفقه وخاصة في الأمور المستجدة، تغلبت الذكر على الأحكام الفقهية المتعلقة ببعض آيات الأحكام وسبقت ذلك بعرض مساقات الترجيح عند الأصوليين البالغ العلاقة مع الأحكام إذ لابد من معرفة قواعد التقريب والتغليب في مباحث الأحكام فالظن والترجيح والموازنة بين المصالح والمفاسد هي مقومات التغليب عند الأصوليين، وأعقبت ذلك بذكر القواعد الفقهية المتضمنة للتغليب, ثم ختمت البحث بتطبيقات من آيات الأحكام للتقريب والتغليب.
