|a إن حق الدفاع الشرعي، حق أصيل أقرته الشرائع الدنيوية منذ قدم البشرية ذلك أن الطبيعة الإنسانية تقوم على حاسة البقاء التي تنشأ لدى المدافع، فإذا ما ثبت قيام حالة الدفاع الشرعي فإن الشخص يعفي من المسؤولية الجزائية والمدنية كاملة، وان المشرع لم يحصر الحالات التي يجوز فيها الدفاع عن الاعتداء الواقع على المال، ويكون مرتكبها مسؤول عن فعله طبقا للقواعد العامة، ويكون المدافع متجاوزا لحالة الدفاع الشرعي إذا ما تخلف أحد شرطي فعل الدفاع (التناسب على الأخص وحينها يستحق بأن توقع عليه عقوبة مخففة ويكون مسؤولا مسؤولية كاملة عن الشق المدني التعويض)، إذ أن للمحكمة العليا سلطة الرقابة على محكمة الموضوع من حيث الإشراف على تطبيق القانون أو تأويله.
