المستخلص: إن ما يعادل الإرهاب في النصوص القانونية والقانونية العراقية هو كلمة "إرهابي" وهي تتوافق مع الجريمة المنظمة (وتعني مجموعة أعمال غير مشروعة ومتماسكة لمجموعة ومكونة من أفراد بالتواطؤ وبهدف الحصول على أموال الفوائد والقوة) والصراع المسلح (بمعنى العداوة مع استخدام الأسلحة وتجهيزها) له عقوبات شديدة ويعتبر أحد أمثلة العنف السياسي. ومن أهم جذور ظاهرة الإرهاب (مثل التحيزات الأيديولوجية، والفقر، والاختلافات الدينية، والعرقية، وانعدام العدالة، وغيرها)، حرمة الإرهاب وقتل الأخوة من البشر، وضرورة العمل على قاعدة حرمة الإنسان مساعدة الآخرين، الخ) وأهم الأسس القانونية (مثل: الضرورة العقلانية لمكافحة الإرهاب، وانتهاك حقوق الإنسان الأساسية، وانتهاك المبادئ العامة للحقوق والسلام والأمن عن طريق الإرهاب و...) في دولة إيران والعراق، من خلال تحليل كل من استراتيجيات الوقاية والعقوبات المرتبطة بها في شكل قوانين لمكافحة تمويل الإرهاب، تم بحث قوانين العقوبات في إيران والعراق بطريقة مقارنة. وتشير نتائج البحث إلى أن أهم حلول منع الإرهاب في قوانين إيران والعراق تتمثل في تقديم نماذج تعتمد على أولوية وتأخير الظهور الوقائي لعملية تشكيل الإرهاب، والتي تتمثل في وشكل المنع على شكل قوانين سلبية فاعلة رادعة، ومنع ظرفي، و... قد كشف العقوبات المتعلقة بجريمة الإرهاب في قوانين إيران والعراق مأخوذة أيضا من النصوص القانونية بالسجن المؤبد أو عقوبة الإعدام في حالة تحليل أبعاد الجريمة وشخصية الشخص المجرم والتي تنص على التعامل معها إرهاب.

What is post-terrorism in Iraqi legal texts is the word "terrorism", which depends on organized crime (which means a group of illegal acts and a group composed of members in collusion and with the aim of obtaining financing, benefits and power). And the conflict requires (in the sense of hostility with the use and equipping of weapons) It has a severe impact on a form of political violence. Among the most important of them are the phenomenon of terrorism (such as ideological nationalisms, poverty, religious and ethnic differences, the execution of justice, and others), the freedom of terrorism and the preservation of the brotherhood of human beings, and the necessity of working on the basis of the inviolability of man. Helping others, etc.) and the most important legal rules (such as: collective prohibition on the prohibition of terrorism, violation of basic human rights, violation of general structures of rights and commitment through terrorism and...) in the state of Iran and Iraq, through an analysis of both the cessation of the ban and its sanctions. In the form of preventing terrorism, laws in Iran and Iraq have been considered in a similar manner. The results of the research indicate that the most important solutions to prevent terrorism in the laws of Iran and Iraq, which are broad in providing models, depend on the final preventive approaches to the process of forming terrorism, which define and form prevention in the form of effective laws that are harmful, deterrent, prevent circumstantial, and... may reveal. As for the crime related to the crime of terrorism in the laws of Iran and Iraq, it also depends on the texts specific to the field or the death penalty in the case of analyzing the crime and the public figure, which helps to deal with their terrorism.
