|a يتناول هذا البحث " مبدأ الحماية القضائية الفعالة " بالتحليل من خلال دراسة مقارنة، في محاولة للوقوف على مفهومه، ونطاقه، ومضمونه من حيث العناصر التي ينطوي عليها، في ضوء كونه بمثابة مظلة حامية للعديد من الحقوق والضمانات المتصلة بحصول الأفراد على حقوقهم من خلال ترضية قضائية منصفة إذا ما تعرضت حقوقهم وحرياتهم للانتهاك، وذلك للوقوف على مدى أهمية التكريس الدستوري له.
|b This research includes “including distinguishing” it through analysis through a comparative study, in an attempt to search for its concept, scope, and content from the elements that belong to it, in light of it being a special protection umbrella of rights and guarantees available to obtain people’s rights through satisfying the judiciary who are fair to them. If their rights and freedoms begin to be violated, in order to determine the extent of the necessity of constitutional enshrinement thereof.
