|a يعد الصلح في الخصومة الجنائية نظام قانوني مستحدث يهدف إلى حل الخصومات الجنائية بغير الطرق التقليدية، ودون الحاجة إلى مرورها بالإجراءات الجنائية العادية، ويقوم هذا النظام على أساس إنهاء الخصومة بعيداً عن الدخول إلى ردهات المحاكم والقضاء ولكن تحت إشرافه، بحيث توكل المهمة لنيابة العامة صاحبة للالتقاء بأطراف الدعوى، ومحاولة الوصول إلى حل بينهما يرضي الطرفين، ولذلك فإن اللجوء لهذا النظام لا يكون إلا رضائياً. وإذا ما اتفق الطرفان فإن القضية تنتهي تبعا لهذا الاتفاق. طبعا وفقا لشروط محددة الشيء الذي يترتب عليه مجموعة من الآثار، وبهذا يساهم هذا النظام إلى توفير في النفقات وفي الجهد وتخفيف عن كاهل القضاء والاكتظاظ في المؤسسات السجنية. وقد ثبت نجاعته، سواء للمتهم أو المتضرر أو للمجتمع على حد سواء.
|b Conciliation in criminal disputes is a new légal system that aims to resolve criminal disputes in other than traditional ways, and without the need for them to go through regular criminal procédures. This system is based on ending the dispute away from entering the halls of the courts and the judiciary, but under its supervision, so that the task is entrusted to the Public Prosecution, which has the right to do so. To meet with the parties to the case, and try to reach a solution between them that satisfies both parties. Therefore, resorting to this system can only be consensual, and if the two parties agree, the case ends according to this agreement, of course, according to specific conditions, which has a number of effects, and thus this contributes. The system saves expenses and effort and reduces the burden on the judiciary and overcrowding in prison institutions. Its effectiveness has been proven, whether for the accused, the affected person, or society alike.
