المستخلص: تناولت هذه الدراسة بحث (التضخم التشريعي في مجال المصادقة على المعاهدات الدولية واثره على جودة التشريعات الداخلية)، حيث أن نفاذ المعاهدات يتطلب إكمال إجراءات عقدها، وتعد المصادقة الإجراء الأكثر أهمية كونها المرحلة التي تعبر من خلالها الدول عن رضاها النهائي بأحكام المعاهدة، وتحدد التشريعات الداخلية الآليات والهيئات المسؤولة عن ذلك الإجراء، وتتسبب كثرة تلك التشريعات بتضخمها عند عدم اعتماد أساليب الصياغة التشريعية السليمة التي تتطلب الاكتفاء بنص واحد واضح المعنى ودمج التشريعات التي تعالج موضوعات متشابهة في قانون واحد، كذلك يشمل الزيادة في حجم التشريع غير المبررة أو تكرار النصوص أو تعارضها مع غيرها من النصوص، فضلا عن عدم توسع المشرع في الاستثناء على أصل القاعدة التشريعية بما يتعارض مع الغاية الأساسية من التشريع. أن التضخم التشريعي يخل بالأمن القانوني وعدم استقرار المراكز القانونية والعلاقات الدولية، ويتسبب بعدم وضوح الأحكام في التشريعات وعدم استقرارها وصعوبة الوصول إليها، وبالتالي يمكن التحجج بعدم استيفاء الإجراءات المحددة للمصادقة، الأمر الذي يتطلب إيجاد معالجات لتلافي حصول التضخم ومعالجته في حال حصوله، لتكون الصياغة التشريعية الخاصة بالمصادقة على المعاهدات صريحة وواضحة وموحدة بعيدة عن الغموض والقصور والتكرار وتفادي تعارض النصوص التشريعية وتناقضها، لتحقيق الاستقرار في التشريعات ودعم الأمن القانوني.

This study examined (Legislative inflation in the field of ratification of international treaties and its impact on the quality of internal legislation), as the entry into force of treaties requires the completion of the procedures for concluding them, and ratification is the most important procedure as it is the stage through which states express their final satisfaction with the provisions of the treaty, and determine internal legislation the mechanisms and bodies responsible for that procedure, and the large number of such legislations cause their enlargement when proper legislative drafting methods are not adopted, which require contenting one text with a clear meaning and merging legislation that addresses similar topics into one law. It also includes cases in which the size of the legislation is unjustifiably large or contains On texts that are repeated or conflict with other texts, in addition to the legislator not expanding the legislative exceptions to the original legal rule, otherwise the exceptions will overpower the general principle, contradicting the basic purpose of the legislation. Legislative inflation disrupts legal security and instability of legal centers and international relations, and causes unclear provisions in legislation, instability, and difficulty in accessing them. Therefore, it can be argued that the specific procedures for ratification have not been met, which requires finding treatments to avoid inflation and address it if it occurs, so that the legislative drafting is The ratification of treaties is frank, clear, and unified, far from ambiguity, shortcomings, and repetition, and avoiding conflicts and contradictions in legislative texts, in order to achieve stability in legislation and support legal security.
