المستخلص: يتناول هذا البحث وظيفة الضبط الإداري، واهم مجال لهذه الوظيفة هي الطرق العامة، فالإدارة مطالبة بإشباع حاجة السير والمرور العام للأفراد، وفي الوقت نفسه مطالبة بالحفاظ على النظام العام، ولكون هذه الإجراءات تمس او تقيد حرية الأفراد ونشاطاتهم، فإنها تتم من خلال سلطات معينة بموجب الدستور او القانون، وتعمل بموجبه على تلك الوظيفة، بما يحقق الملائمة لجميع عناصر النظام العام على الطرق وفي اطار المشروعية والإدارة عند ممارستها لهذه الوظيفة فإنها لا تحل محل النشاط الفردي، بل تخضعه وتضع له ضوابط حتى لا ينحرف عن مساره ودوره او الغاية الذي أنشئ من أجله، مستعينة بذلك من خلال أدواتها وأساليبها وضمن واجباتها في الحفاظ على النظام العام، فهي تتخذ أنظمة ضبطية تتضمن مجموعة قواعد عامة ومجردة، تضع قيوداً على نشاط الأفراد، وبناء على ذلك تصدر القرارات الفردية تطبيقاً لهذه الأنظمة او تطبيقاً للقانون، والتي تخاطب أشخاصا معينين بذواتهم، وتتخذ الأنظمة الضبطية صورا عدة منها الحظر و تنظيم النشاط و الإذن المسبق والأخطار، وقد تمارس الإدارة أساليبا أخرى تأخذ شكل تدابير وقائية تهدف للحفاظ على النظام العام او تفادي الإخلال به تدعى الجزاءات الإدارية الوقائية، وهي على صور متعددة، فقد تكون على شكل غرامات محددة سلفا لكل من يخالف النصوص القانونية أو قد تكون اشد من ذلك بسحب الترخيص استعمال الطريق، وقد تكون من خلال نزع المال جبرا ومن دون مقابل وهو ما يسمى بالمصادرة الإدارية المؤقتة، وكل هذه الإجراءات الهدف منها هو الحفاظ على النظام العام على الطرق بكل عناصره المادية والمعنوية والتي تشمل (الأمن العام والصحة العامة والسكينة العامة والآداب والأخلاق العامة وجمال ورواء الطرق العامة).

This study deals with the function of administrative control, in which public roads are considered the most important field. However, the administration is required to provide satisfying public traffic for individuals, and at the same time, it is required to maintain public order. However, because these procedures affect or restrict the freedom of individuals and their activities, they are carried out through specific time based on the constitution or the law which, in turn, achieves the compatibility of all elements of public order on the roads and within the framework of legitimacy. The administration practices this function smoothly to the extent that the procedures do not disturb individual activities. Hence, these procedures set controls for the individuals so that they will not deviate from the planned paths. Accordingly, using this through its tools and methods and within its duties to maintain public order, it adopts disciplinary systems that include a set of general and abstract rules that place restrictions on the activity of individuals. Accordingly, individual decisions are issued in the application of these regulations or in the application of the law, which addresses specific people. The disciplinary systems take several forms, including prohibition, regulation of activity, prior authorization, and notification. The administration may practice other methods that take the form of preventive measures aimed at preserving order or avoiding breaches of it, called Preventive Administrative Sanctions. They are of different forms, they may be in the form of predetermined fines for anyone who violates the legal provisions, or they may be more severe than that by withdrawing the driving license. It also could be through the forcible and free expropriation of money, which is called The general Administrative Sanctions. However, all these sanctions aim to maintain public order on the roads with all its material and moral elements. This includes (public security, public health, public tranquility, morals, public morals, and the beauty and cleanliness of public roads).
