|a القضاء المختص في تحديد قواعد اختصاص النزاع الضريبي: أن القوانين المكتوبة هي نتائج إرادة الإنسان، ومن ثم فان خلقه كشأن أي فعل إنساني عملا إنشائيا مليئا بالنقائض والقصور، وحيث أن وظيفة القاضي لا تقتصر على تطبيق التشريع النافذ فحسب، وإنما النظر في مخالفة القانون أو خطأ في تطبيقه أو عيب في تأويله، أو كان الحكم قد صدر على خلاف قواعد الاختصاص، أو وقوع خطأ في الإجراءات الأصولية التي أتبعت عند مباشرة الدعوى ووجد انه يؤثر في صحة الحكم، أو إذا صدر حكم يناقض حكما سابقا صدر في ذات الدعوى بين المتنازعين أنفسهم أو من مقام مقامهم، أو حتى الحكم الذي حاز درجة البتات إذا وقع فيه خطأ جوهري، فبالإضافة إلى وظيفته تلك، له أن يضع أو يخلق القاعدة المطبقة على النزاع.

Since the judge’s function is not limited to applying the applicable legislation only, but also to considering a violation of the law or an error in its application or a defect in its interpretation, or if the ruling was issued contrary to the rules of jurisdiction, or an error occurred in the original procedures that were followed when the lawsuit was initiated and it was found that it affected the validity of the ruling, or if a ruling was issued that contradicts a previous ruling issued in the same lawsuit between the same disputants or from their position, or even a ruling that has attained the degree of finality if it contains a fundamental error, then in addition to his function, he has the right to establish or create the rule applied to the dispute.
