|a يهدف هذا البحث إلى إبراز جهود الأصوليين في الاستدلال على القواعد الأصولية بنصوص الكتاب والسنة، وبيان أن علم الأصول لا ينفك عن النصوص تأصيلاً وتقعيدًا، كما لا تنفك هي عنه فهمًا وتوجيهًا. ومن خلال ذلك أظهر البحث كيف تفاوتت أنظار الأصوليين للنص الواحد فأثمرت أقوالاً أصولية ليست من باب الأقوال المختلفة فحسب، بل من باب الأقوال المتقابلة، الذي يكون كلُّ قول على النقيض من القول الآخر. وجاء البحث في مقدمة وثلاثة مباحث مرتبة على المشهور من ترتيب الأبواب الأصولية، فاختص المبحث الأول بمسائل الحكم الشرعي والتكليف، والمبحث الثاني: بمسائل الأدلة، والمبحث الثالث: بمسائل طرق الاستنباط، ومن أهم نتائج البحث: إظهار أثر السياق، وأساليب اللغة، وفهم الصحابة للخطاب الشرعي، في إيجاد هذه الأقوال الأصولية المتقابلة المستنبطة من النصوص.
|b This research aims to highlight the efforts of fundamentalists in inferring fundamental rules from the texts of the Qur'an and Sunnah, and to show that the principles of jurisprudence are not indispensable for legal texts in terms of rooting and complexity, just as they are not indispensable in understanding and guidance. Through this, the research showed how the fundamentalist views of one text varied, yielding fundamentalist statements not only from the section of different statements, but also from the section of opposing statements. The research included an introduction and three sections arranged according to the well-known order of the fundamentalist sections Among the most important results of the research: showing the impact of context, language styles, and the understanding of the Companions in creating these opposing fundamentalist opinions deduced from texts.
