تناولت الدراسة موضوع الإرهاب في القانون الدولي الإنساني من خلال التعرف على مشكلة الدراسة المتمثلة في ماهية الإرهاب الدولي متتبعة تاريخ الإرهاب وتطوره تحت مظلة القانون الدولي الإنساني بعملياته المختلفة، وأيضا تناولت الدراسة الاختلاف الجوهري بين القانون الدولي الإنساني والقانون الدولي لحقوق الإنسان في مفهوم الإرهاب، تمثلت أهمية الدراسة في لفت النظر والاهتمام بتلك الظاهرة الخطيرة والتي تهدد الأمن الدولي، وتهدف الدراسة أيضا لتحفيز القانون الدولي الإنساني مجابهة هذه الظاهرة بكل السبل، كما افترضت الدراسة أنه من المتتبع والدارس المواضيع الإرهاب أنه لا يوجد تعريف واضح متفق عليه لهذه الظاهرة الخطيرة مما يشتت مستخدمي القانون الدولي في معالجة هذه الظاهرة، استخدمت الدراسة المنهج القانوني والمنهج التحليلي الوصفي في طرحها هذا، كما توصلت الدراسة لعدة نتائج منها أن القانون الدولي لحماية الإنسان أشمل في تعامله مع الإرهاب الدولي من القانون الدولي لحقوق الإنسان وتوصلت الدراسة أيضا لعدد من التوصيات منها مراجعة وتنقيح.
This study focused on the issue of the terrorism in the international public law through the identification of the problem of the study depending on the definition of Terrorism and following the history of Terrorism and its development under the umbrella of the humanitarian international law, including its various types and operations. The study also revealed the essential difference between the humanitarian international law and the international human rights law regarding the Terrorism definition, hence the study importance stems from the draw of the attention of the international community for the need to pay attention to this serious phenomenon which threaten the international security. Also the study aimed to stimulate the international human rights law to face this problem by all means to protect the international peace and the security of civilians. The study hypotheses that searching and tracking of the Terrorism issues, find that there is no specific and clear definition for this serious phenomenon agreed upon, which distracts the thoughts of those who are supposed to apply the international law in processing this phenomenon.
