|a نص التشريع الوظيفي الجزائري على أن للموظف الحق في الاستفادة من راحة أسبوعية يوما كاملا خلال نهاية أسبوع العمل، ومن حقه أيضا الاستفادة من الراحة في أيام الأعياد؛ ونظم له يوم الراحة الأسبوعية الذي يحل دوريا كل أسبوع، وأيام الأعياد بتاريخها ومناسباتها ومسمياتها وعددها وعدد أيامها خلال السنة. غير أن استفادة الموظف من الراحة كما سبق ليس من النظام العام، لأنه يمكن للإدارة استدعاءه للعمل في يوم الراحة الأسبوعية، أو في أي يوم من أيام الأعياد لضرورة المصلحة، ومنحه راحة تعويضية مماثلة.
