|a يعالج هذا البحث، الأدوار التشريعية والرقابة التي يساهم بها القضاء الدستوري في العمل التشريعي، من خلال جُملة مداخل تسهم في إضفاء التوازن بين السلطتين التشريعية والتنفيذية، وضبط مساحات المجالين القانوني والتنظيمي. وقد منح دستور 2011 للقضاء الدستوري إمكانيات تعزز من استقلاليته وصلاحياته، لتحقيق هذه الأدوار، وفرض تكافئ بين السلطتين، رغم ما يمكن استنتاجه من مجموع قرارات المحكمة الدستورية ومن التجارب المقارنة من تغليب لمجال التنظيم على مجال القانون، وذلك لصعوبة ضبط المساحة بينهما وإشكالية تدقيق ما يندرج تحت كل اختصاص يهم السلطة التنفيذية والسلطة التشريعية.
|b This research studies the legislative and oversight roles played by constitutional judiciary in legislative work, through a set of approaches that contribute to maintaining balance between the legislative and executive branches, and regulating the legal and regulatory domains. The 2011 constitution has endowed the constitutional judiciary with capabilities that enhance its independence and authority to fulfill these roles, and to enforce parity between the two branches of power, despite what can be inferred from the cumulative decisions of the constitutional court and comparative experiences indicating a predominance of regulatory scope over legal domain, this is due to the difficulty defining the boundaries between them and the challenge of precisely delineating what falls under each jurisdiction concerning the executive and legislative branches.
