|a يهدف هذا البحث إلى دراسة دور المجلس الدستوري الموريتاني في الرقابة على دستورية القوانين للتحقق من دستوريتها في إطار ضبط العلاقة التدريجية بين القواعد القانونية. وقد لاحظنا أن المجلس الدستوري، نشأ كهيئة سياسية لرقابة دستورية القوانين، قبل أن تتطور رقابته إلى رقابة شبه قضائية بموجب التعديل الدستوري في 2017 مما سمح للأفراد بالدفع بعدم الدستورية أمام المجلس، لكن رم ذلك يبقى الطابع السياسي للمجلس الدستوري واضحا من حيث التشكيل والاختصاص، وهو ما يحد من رقابته على دستورية القوانين التي لا تطال في الواقع سوى القوانين النظامية.
|b This research aims to study the role of the Mauritanian Constitutional Council in monitoring the constitutionality of laws to verify their constitutionality within the framework of controlling the gradual relationship between legal rules. We have noted that the Constitutional Council arose as a political body to monitor the constitutionality of laws, before its oversight evolved into a quasi-judicial oversight under the constitutional amendment in 2017, which allowed individuals to argue unconstitutionality before the Council, but the political nature of the Constitutional Council remains clear in terms of formation and competence, which is This limits his control over the constitutionality of laws, which in fact only affect regular laws.
