المستخلص: يتناول هذا البحث موضوع خصخصة التعليم من منظور حقوق الإنسان؛ إذ إنه على الرغم من أن الدولة هي المسؤولة عن ضمان الحق في التعليم للأفراد، إلا أن مبدأ خصخصة قطاع التعليم، عن طريق إسناد مسؤولية التعليم إلى القطاع الخاص، أدى إلى عدة تساؤلات بشأن مدى تأثير الخصخصة على الحق في التعليم. فبينما يحتج المؤيدون بأن الخصخصة تزيد من جودة وكفاءة التعليم، يحتج المعارضون بأن إسناد العملية التعليمية إلى القطاع الخاص، بدون وضوح في الإجراءات والقوانين، قد يؤدي إلى حرمان الكثير من الأفراد من حقهم في التعليم. يوضح هذا البحث مدى تأثر الحق في التعليم بالخصخصة، وذلك من خلال بيان مفهوم الحق في التعليم وفقاً للقانون الدولي لحقوق الإنسان، والالتزامات الناشئة على الدول نتيجة تطبيق هذا الحق، ومن ثم تعريف الخصخصة في التعليم، وبيان طرقها المختلفة، مع توضيح تأثيرها في حقوق الإنسان. يستنتج البحث بعض الإشكالات الناتجة عن تطبيق الخصخصة في مجال التعليم، ومن ثم يقترح بعض الآليات المختلفة لمعالجتها في مجال التعليم.

This research addresses the issue of privatization of education from a human rights perspective. While the state is responsible for guaranteeing the right to education for individuals, the principle of privatizing the education sector, by assigning responsibility for education to the private sector, has raised several questions regarding the impact of privatization on the right to education. Proponents argue that privatization improves the quality and efficiency of education, while opponents contend that entrusting the educational process to the private sector, without clarity in procedures and laws, may lead to depriving many individuals of their right to education. This research explains the extent to which the right to education is affected by privatization, by explaining the concept of the right to education in accordance with international human rights law, and the obligations of states resulting from the implementation of this right, and then defining privatization in education, outlining its various forms, and clarifying its impact on human rights. The research concludes by identifying some of the issues arising from the implementation of privatization in the field of education and proposes various mechanisms to address them in the field of education.
