|a هدفت هذه الدراسة إلى البحث في الرقابة الدستورية في النظام الداخلي لمجلس الأردني، وذلك من خلال البحث في دستوريتها ومدى اعتبارها من القواعد الإجرائية التنظيمية لغايات المادة (83) من الدستور، التي تعطي الحق لكل من مجلسي الأعيان والنواب بأن يضعا أنظمة داخلية لضبط وتنظيم إجراءاتهم، على أن تعرض هذه الأنظمة على الملك للتصديق عليها. وبيان الدور الذي يلعبه القضاء كجهة قضائية مختصة يمكن أن تبسط رقابتها على توافق النصوص الواردة في النظام الداخلي بحلته المعدلة مع أحكام الدستور، ومدى إمكانية أن ينعقد هذا الاختصاص للمحكمة الدستورية في الرقابة على احترام النظام الداخلي لمجلس النواب لأحكام الدستور استناداً للمادة (59) من الدستور والتي حصرت اختصاصات المحكمة الدستورية بالرقابة على دستورية القوانين والأنظمة النافذة، وهو النص الذي جرى تكريسه في المادة (4) من قانون المحكمة الدستورية رقم (15) لسنة 2012 وتعديلاته، وذلك من خلال البحث في مفهوم الأنظمة واللوائح الداخلية للبرلمان الأردني بشكل عام، وبيان تعريفها، وأهمية وضعها وطرق الرقابة الدستورية وجهاتها المختصة، ومرتبتها القانونية بالمقارنة مع الإطار الدستوري لها.
|b This study aims to examine constitutional oversight in the internal regulations of the Jordanian Parliament by investigating their constitutionality and whether they are considered procedural and regulatory rules under Article (83) of the Constitution. Article (83) grants both the Senate and the House of Representatives the right to establish internal regulations to organize their procedures, provided that these regulations are submitted to the King for ratification. The study also highlights the role of the judiciary as a competent authority that can oversee the compatibility of the amended internal regulations with the provisions of the Constitution. Furthermore, it explores the possibility of the Constitutional Court assuming jurisdiction to review the internal regulations of the House of Representatives for compliance with the Constitution, based on Article (59) of the Constitution. This article limits the jurisdiction of the Constitutional Court to reviewing the constitutionality of enacted laws and regulations, a principle enshrined in Article (4) of the Constitutional Court Law No. (15) of 2012 and its amendments. The study delves into the concept, definition, and importance of internal regulations for the Jordanian Parliament, the mechanisms and authorities of constitutional oversight, and their legal hierarchy compared to the constitutional framework.
