|a بين الباحثان مفهوم اتفاق العاقدين على إخفاء عوض وإعلان غيره، بأنه إخفاء لأحد أجزاء العقد مع اجتماع إرادة العاقدين على قصد أصله، وأن هذا الاتفاق قد يكون سابقا للعقد تسري آثاره عليه باعتبار المقاصد، وأن الشروط السابقة معتبرة في العقد، وقد يكون الاتفاق لاحقا للعقد وحينها لا يؤثر فيه إلا إذا وقع في زمن الخيارين. والبواعث هي الدوافع الذي تحرك إرادة العاقدين لإنشاء التصرف للحصول على غرض غير مباشر، وبالاستقراء؛ تنقسم البواعث إلى بواعث جائزة، وبواعث محرمة، ويتأثر حكم العقد بحسب نوع الباعث عليه. وتوصل الباحثان إلى منع إخفاء العوض الحقيقي عند بيع المسكن للاستفادة من ميزات قانون من باع بيته رقم (٢) لسنة 2015م في دولة الكويت، وكذلك منع إخفاء العوض الحقيقي عند بيان قيمة السلع المستوردة من الخارج، أما إخفاء المهر الحقيقي في عقد النكاح فهو جائز؛ أن كان الباعث عليه مراعاة الظروف الاجتماعية، أما أن كان الباعث عليه هو المباهاة والسمعة، والمغالاة في المهور، أو تخفيف الرسوم والتخلص من القيود التي فرضتها التشريعات، فإنه غير جائز.
|b The researchers have explained the concept of an agreement between contracting parties to conceal the contract price and announce another. They have conducted a thorough analysis, providing reassurance about the validity of the study’s findings. In contrast, both parties’ intentions are aligned on the essence of the agreement. This agreement, which may precede the contract, has its effects applied based on the parties’ intentions, as prior conditions are considered part of the contract. Alternatively, the agreement may occur after the contract, in which case it does not affect the contract unless it takes place during the option period. The motives drive the parties’ will to initiate the transaction to achieve an indirect purpose. Based on analysis, motives are divided into permissible and impermissible types, and the contract's validity is influenced by the kind of motive behind it. After thorough research and analysis, the researchers have drawn significant conclusions. They have found that concealing the actual contract price in the sale of a residence to benefit from the advantages of Law No. 2 of 2015 in Kuwait is prohibited. Similarly, concealing the actual contract price when declaring the value of imported goods is also prohibited. However, concealing the actual contract price in a marriage contract is permissible if the motive is to accommodate social circumstances. It is impermissible if the motive is for boasting, enhancing reputation, excessive dowries, or evading fees and legal restrictions. These conclusions provide a comprehensive understanding of the legal implications of concealing contract price.
