|a يتناول البحث دراسة موضوع الاختصاص المحلي لقاضي التنفيذ وأهميته عبر القوانين المنظمة له وما لحقها من تعديلات وبيان الإشكاليات العملية التي تترتب على إعمال القواعد العامة في الاختصاص المحلي وموقف المشرع المصري وغيره من التشريعات العربية من هذه الإشكاليات ودور الفقه القانوني في الدول العربية في التصدي لإشكاليات الاختصاص المحلي والبحث عن الحلول المناسبة للقضاء عليها. ويعمد البحث إلى تأصيل الأفكار القانونية التي تخدم الموضوع من ناحية الفقه القانوني والفقه الإسلامي مع الربط بالتطبيقات العملية في كل من النظامين. ويركز البحث على إبراز دور الإنابة القضائية في التنفيذ، بوصفها حلا جذريا لكافة الإشكاليات التي تعترض إجراء التنفيذ على ضوء الاختصاص المحلي لقاضي التنفيذ وبيان مدى مشروعيتها وجدواها في التشريعات الوضعية والفقه الإسلامي وذلك في محاولة لمناشدة المشرع المصري ضرورة التدخل التشريعي لتنظيم مسألة الإنابة القضائية في مجال التقاضي والتنفيذ.
|b The research deals with studying the issue of the local jurisdiction of the execution judge and its importance through the laws regulating it and subsequent amendments, and explaining the practical problems that result from implementing the general rules in local jurisdiction, the position of the Egyptian legislator and other Arab legislation on these problems, and the role of legal jurisprudence in Arab countries in addressing the problems of local jurisdiction. And search for appropriate solutions to eliminate them. The research seeks to establish the legal ideas that serve the subject in terms of legal jurisprudence and Islamic jurisprudence, while linking it to practical applications in each of the two systems. The research focuses on highlighting the role of judicial delegation in implementation, as a radical solution to all the problems that obstruct the implementation procedure in light of the local jurisdiction of the implementation judge, and explaining the extent of its legitimacy and feasibility in positive legislation and Islamic jurisprudence. This is in an attempt to appeal to the Egyptian legislator to the necessity of legislative intervention to regulate the issue of judicial delegation in the field of litigation and implementation.
