أن العقود الإدارية تعد أداة يمكن للإدارة استخدامها، من أجل تسير المرافق العامة التابعة لها بانتظام واطراد، وفي ذلك يجب أن تبتغي الصالح العام، وفي ذلك تقول محكمة القضاء الإداري "...إذ يجب أن يراعي فيها دائما- وقبل أي شيء- تغليب الصالح العام على مصلحة الأفراد، وهذا الهدف يجب أن يسود شروط العقد وعلاقة المتعاقدين في تطبيقه، وتفسيره، وفي إنهائه" وحتى تستطيع الإدارة ذلك، فإنها تتمتع بسلطات انفرادية لا مثيل لها في قواعد القانون الخاص، ومن تلك السلطات سلطتها في تعديل العقد بشكل منفرد، دون أن يكون من حق الطرف الآخر المجادلة في ذلك، ما دام يستهدف الصالح العام. ولذا فكرت في إعداد هذا البحث؛ كي أتناول فيه فكرة التعديل الانفرادي، فتكلمت عن مدلول التعديل، ثم قارنت بين هذه السلطة وما يشابها من سلطات، ثم بينت حدود التعديل والقيود الواردة عليه، ثم بينت الإنهاء المبكر للعقد بوصفه نوعا من التعديل الانفرادي. وهذا الموضوع بحاجة لمزيد من الأبحاث، حتى يتبين، وتتضح معالمه، وأتمنى أن يكون هذا البحث بداية لأبحاث أخرى.
Administrative contracts are an instrument of management for the regular and steady functioning of its public utilities, which must be in the public interest, and the Administrative Court of Justice states that "... It must always and above all take into account the superiority of the public interest over the interests of individuals, and this objective must prevail over the terms of the contract and the relationship of the contractors, in its application, its interpretation and its termination" In order for the Administration to do so, it has unilateral powers unparalleled in the rules of private law, including its power to modify the contract unilaterally/without the other party's right to argue, as long as it is aimed at the public good. So I thought about preparing this research, to address the idea of a unilateral amendment, and I spoke about the meaning of the amendment and then I compared this and similar powers, and then I outlined the limits and limitations of the amendment and then I built the early termination of the contract as a kind of unilateral change. And this subject needs more research, so that it becomes clear, and I hope that this research will be the beginning of other research.
