|a إن المنافسة العامة يحكمها عدد من المبادئ هي: العلانية، وحرية المنافسة، والمساواة والشفافية وتكافؤ الفرص، وأن مبدأ حرية المنافسة وإن كان مقتضاه ألا يجوز استبعاد شخص وحرمانه من الدخول في المنافسة، فإن المصلحة العامة تستوجب منح الإدارة سلطة في استبعاد العروض في أحوال معينة؛ وإذا ما تم الاستبعاد في نطاق الحدود النظامية فإنه لا يخل بمبدأ حرية المنافسة؛ لأن ذلك تفرضه المصلحة العامة. كما أن هناك ضمانات نظامية يكفلها النظام للمتنافسين في مقابل منح الإدارة هذه السلطة، ومنها حق التظلم لجهة الإدارة وأمام اللجان الإدارية المختصة، كما بين النظام الآثار المترتبة على قبول التظلم أو إلغاء قرار الاستبعاد بالنسبة للمتنافسين وبالنسبة لجهة الإدارة.
