|a الأصل في الالتزامات أنها مستحقة الأداء بمجرد نشوئها، حسب ما نصت عليه المادة 281 من القانون المدني الجزائري، إلا أنه يجوز للقاضي أن يمنح المدين أجلا لتنفيذه إذا ما تعذر عليه الوفاء، وهو ما يعرف بنظرة الميسرة يحقق تطبيق نظرة الميسرة على العقد المدني توازنا في العلاقات بين الأفراد ومصالحهم من خلال السلطة الممنوحة للقاضي في تعديل العقد في مرحلة تنفيذه وخروجه عن أهم مبدأ من المبادئ القانونية التي تحكم العقد وهي قاعدة العقد شريعة المتعاقدين المنصوص عليها في المادة 106 من القانون المدني الجزائري.
|b The origin of the obligation is that they are destined for enemies as soon as they arise as stipulated in article 281 of the algerian civil code but the judge may grant the debtor a solution to implement it if he is unable to fulfill which is known as the facilitator view The applicaion of the facilitator’s view of the civil contract achieves a balance in the relations between individuals and their interests through the authority granted to the gudje to amend the contract at the its implimentation and its departure from the most inportant we start from the legal principles that govern the contract wich is the rule of the contract pacta sunt servanda stipulated in article 106 of the algerian civil code.
