المستخلص: Praise be to Allah and peace and blessings be upon His Messenger, Mohammed, his family and Comapnions, To proceed, This study deals with the division of ijtihad, its nature, ruling, and the relevant differences of opinion among legal theorists. The first discussion comprises a definition of the “division of ijtihad" based on the words’ grammatical status, and as a technical term used for a specialized issue. he study then concludes with a third discussion which explains the nature of the difference concerning the topic at hand. It is concluded that the difference is linguistic in nature, and leads to a difference in opinion regarding subsidary issues. Several expamples are mentioned. I ask Allah the Almighty to grant us His favor and munificence to show us the truth so that we may follow it. We ask Him to reveal to us the true nature of evil so that we may avoid it for He is the all-Powerful. As our final invocation, we say that all praise is to Allah, Lord of the worlds and peace and blessings be upon our prophet, Mohammed, and upon his family, Companions and those who follow him until the Last Day.
