البحث يتكلم عن صندوق القبيلة أحكامه وضوابطه الشرعية وعلاقته بالعاقلة في تحمل الديات للباحث صالح بن علي الشمراني، والصندوق وعاء اعتباري تواضع عليه كثير من القبائل، يجمعون فيه مبلغا من المال قد يستثمرونه ويصرفون منه ومن أرباحه في دفع الديات التي تجب على أحد أعضائه، وتوصل البحث إلى مشروعية هذا الصندوق من خلال خمسة عشر وجها، وأنه من أفضل البدائل عن العاقلة عند فقدها أو تفرقها، لكنه لا يلغي أحكامها في حق غير المشتركين، وفرق بينه وبين العاقلة بأربعة عشر فرقا، ومن ضوابطه: أن يكون الاشتراك على جهة التراضي البعيد عن الشحناء والشقاق بين أفراد القبيلة، وأن يتسامح في حق الفقراء ونحوهم، وأن يتاح لكل مشارك أن ينسحب من الصندوق عند عدم رغبته الاستفادة منه، ولو مات المشارك أو خرج من الصندوق قبل لزوم الدية ودفعها إلى مستحقيها فإن ماله يعود إليه أو إلى ورثته، وألا يصرف منه في غير ما وضع له إلا برضا جميع المشاركين أو تفويضهم لمجلس الإدارة بخصوص ذلك، وألا يصرف منه من باب السياسة الشرعية على جنايات العمد، أو الجنايات الناتجة عن سكر ونحوه، وتجب الزكاة على كل مساهم في مجموع سهامه ما لم يدفعها على وجه التبرع الدائم، و لا يجوز دفع الزكاة لهذا الصندوق لأنه خارج عن مصارفها الشرعية. \
