تهدف هذه الدراسة إلى بيان: ( مدى حق المفقود في استعادة زوجته إلى عصمته بعد الحكم بموته)، وقد تناولته في ثلاثة مباحث، عرفت في المبحث الأول المفقود: لغة واصطلاحا، وفي المبحث الثاني تناولت الآثار التي تعالج حال المفقود، وفي المبحث الثالث بينت مدى حق المفقود في استعادة زوجته إلى عصمته بعد الحكم بموته؛ فقد أثبت البحث أن زوجة المفقود تبقى زوجته ما لم يحكم القاضي لها، فإذا حكم القاضي ينبغي عليها أن تتربص، وتعتد، فإذا حضر زوجها المفقود فهي له دون حاجة إلى عقد جديد، وكذلك إذا عقدت على رجل آخر، ولم يدخل بها، فهي زوجته)المفقود(؛ أما إذا دخل بها الثاني، وظهر زوجها المفقود حيا، فقد توصل البحث: أن زوجها المفقود يخير بين زوجته، وبين صداقها.
