المستخلص: الأصل أن حق الملكية يثبت للشخص الذي يتوصل للاختراع، بشرط أن يكون هذا الاختراع مستوفياً للشروط التي حددها قانون براءات الاختراع؛ باعتبار أن الاختراع ناتج عن جهده الفكري وثمرة عمله الفكري، وهذا الحق هو حق ملكية أصيل مقرر بموجب مختلف القوانين، ولكـن قّـد يقـوم شخص بالتعاقد مـع غيره للتوصل لاختراعات، ويكون حـق هذا الشخص المتعاقد (صاحب العمل) منصباً على تملك هـذه الاختراعات، فالهدف من إبرام العقد؛ أن يقوم العامل بالبحث وإجراء التجارب للتوصل للاختراعات، فإذا توصل إليه تثبت لصاحب العمل جميع الحقوق المالية الناتجة عنه، فما الطبيعـة القانونية لحـق صاحب العمل في تملك الاختراع الذي يتوصـل إليه العامل أثناء تنفيذ عقد العمل.

Basically, the property right shall be firmly awarded to the person who conducts the invention, provided that such invention should fulfill all the conditions and requirements stipulated by the patents act, as the invention is the product of his/her intellectual effort and materialistic work. This right is a genuine property right, duly determined by the different laws. But one may hold a contract with another person to conduct this invention; and the right of this contracting person (the employer) will be focused on the proprietorship of these inventions. So the purpose of conducting the contract is that the worker (employee) will carry out the search, experiments that lead to the invention. Once the employee completes the invention, then the employer will be confirmed with all the financial rights entailed by this contract. Therefore, what is the legal nature of the employer's property right in the ownership of the invention made by the worker during the validity period of the contract?
