This study addresses one of the illusive fundaments cited by Imam Al-Ghazali in his fundamentals books, which is Istislah (building Sharia rules upon the legislatively recognized absolute good) or the ‘Absolute Good’. And it demonstrates his views on it. The study addresses the sections and types of provisions of The Good’ and explains its definition in the Arabic language and the Islamic terminology; and Imam Al-Ghazali’s definition of it. It also explains the sections of the good in terms of lawmaker’s recognition of it. The study is a demonstration of evidence of Sharia’s observance of the good from the Holy Quran and the Sunnah. The study addresses a demonstration of scholars’ views on the absolute good in terms of acceptability, and explains the substantiations of those who refused considering its affirmativeness and of those who accepted it; and demonstrates the preponderant view, and that both can be followed according to specific terms. The study then shows examples of following the absolute good with concentration on and explanation of Imam Al-Ghazali’s view on all of that.
تعالج هذه الدراسة أصلًا من الأصول الموهمة التي أشار إليها الإمام الغزالي في كتبه الأصولية، وهو الاستصلاح أو المصلحة المرسلة. وبيان رأيه فيها. وتناولت الدراسة أقسام الأحكام وأنواعها وبيان تعريف المصلحة في اللغة والاصطلاح وتعريف الإمام الغزالي للمصلحة وكذلك بيان أقسام المصلحة من حيث اعتبار الشارع لها وعدمه. وكذا بيان الأدلة من القرآن والسنة على مراعاة الشريعة للمصالح. وتناولت الدراسة بيان آراء العلماء في المصلحة المرسلة "أي النوع الثالث من المصالح" من حيث القبول وعدمه وبيان أدلة المانعين من الاحتجاج بها وأدلة القائلين بها وبيان الراجح وأنه يمكن الجمع بين القولين بشروط للعمل بها. ثم تناولت الدراسة نماذج وأمثلة للعمل بالمصالح المرسلة، مع التركيز على بيان رأي الإمام الغزالي في كل ذلك.
