The UN Security Council is mandated by the UN Charter to maintain international peace and security. The Council has to take the appropriate measures to achieve this goal. Also, the International Criminal Court with the prosecution of perpetrators of international crimes can contribute to the efforts to avoid conflicts that threaten in¬ternational peace and security, Therefore, the efforts of the Security Council and the international Tribunal intersect, but how each one of them deals with the conflict is different because of the political nature of the first one and the judicial nature of the second. However, the role of Security Council can’t be ignored in the provision of the Rom Convention of 1998, where the basic system has ensured the council’s in¬terference in the work of the court through the authority of assigned by Article 13/b and deferral by Article 16/2. The establishment of the Permanent Court attempts to exclude the involve¬ment of the Council as a political organization in the legal action. The present study will address the relationship between the Criminal Court and the Security Council, and to what extent can the Council as a political organiza-tion influence the independence of the Court as a judicial one.
