يتناول هذا البحث موضوع حماية المدنيين في أوقات النزاعات المسلحة وذلك انطلاقاً من الأحكام والاعتبارات العامة التي تحتم أن يكون للأشخاص المحميين- في جميع الأحوال- حق الاحترام لأشخاصهم وشرفهم وحقوقهم العائلية وعقائدهم الدينية وعاداتهم وتقاليدهم. ويجب معاملتهم في جميع الأوقات معاملة إنسانية، وحمايتهم بشكل خاص ضد جميع أعمال العنف أو التهديد، وضد السباب وفضول الجماهير( ). كما أن لهم الحق في حماية ممتلكاتهم المدنية والثقافية ودور عباداتهم وبيئتهم التي يعيشون فيها. تناولت الدراسة حماية المدنيين في أوقات الحروب والنزاعات المسلحة والتي غالباً ما تتعرض فيها سلامتهم البدنية والنفسية لمخاطر عدة يتحتم معها توفير المزيد من الحماية والرعاية لهم. تم التركيز بصفة خاصة على الحماية المتعلقة بالنساء والأطفال وذلك باعتبارهم الفئة الأكثر تضرراً عندما تدور رحى الحروب، وسوف يتم تناول كل ذلك من خلال التعريف بالأشخاص المدنيين حسبما وصفتهم الاتفاقيات الدولية، وماهية الحماية التي يجب أن تتوفر لهم إبان النزاعات المسلحة، كما سوف يتم توضيح السبيل إلى تلك الحماية وذلك من خلال الطرق والوسائل التي من شأنها تمكينهم من التمتع بها.
This research is a study of the protection of civilians during armed conflicts in accordance with the general provisions and considerations that entitle the protected persons, in all circumstances, respect of their persons, family rights, religious convictions, customs and traditions. They have to be treated, at all times, humanely, and protection, in particular, against all acts of violence, threats, insults and public curiosity) •) . They also have the right of protection to their civilian and cultural property, their facilities of worship and their homes. In addition to the general considerations mentioned earlier, this research covers the basis of protection of civilian persons in general. Those considerations gain momentum. The need for more protection and care keeps mounting as the civilian persons and property get exposed to unusual situations and circumstances that require the application of more protection and care to that category. Relying on the above principle, we studied the protection of civilians in time of armed war and conflict that normally expose their physical and mental safety to threat demanding protection and care. We will concentrate, in particular, on the protection relevant to women and children, being the category most hurt when war is waged. We will approach that through the definition of civilian persons as specified by international agreements, and what kind of protection that should be available for them during armed conflict. We will also show the ways to gain such protection.
