|e هدفت الدراسة الى الكشف عن اتفاقات التعاون في العقود الدولية للإنشاءات وأثرها على امتداد شرط التحكيم. وتناولت الدراسة اتفاقات التعاون في العقود الدولية للإنشاءات والمقصود بالعقود الدولية للإنشاءات وخصائصها وتمييزها عن غيرها. ثم تطرقت بعد ذلك إلى المقصود باتفاقات التعاون وأنواعها المختلفة. وخصائص العقود الدولية للإنشاءات وتمييزها عن غيرها. كما استعرضت الدراسة أهم تلك الأنواع وأكثرها شيوعا في العمل وهما اتفاقات الكونستريوم واتفاق المشروع الدولي المشترك. ثم ناقشت نطاق شرط التحكيم في اتفاقات التعاون. بالإضافة الى تسليط الضوء على الطبيعة القانونية لاتفاقات الكونسرتيوم. والتنظيم القانوني لاتفاق الكونسرتيوم. كما ناقشت نطاق اتفاق التحكيم والدوافع التي تبرر الخروج عليها. ونطاق شرط التحكيم في اتفاقات التعاون سواء كان ذلك في مجموعة العقود أو في مجموعة الشركات. \nوأشارت نتائج الدراسة الى أن الطبيعة الخاصة للعقود الدولية للإنشاءات تقتضي ضرورة الاعتداد بإرادة الأطراف في امتداد شرط التحكيم إلى أطراف العقود الأخرى المكونة للمجموعة العقدية التي ينتمي إليها العقد الوارد به شرط التحكيم دون أن يعد ذلك استثناء عن الأصل العام بشأن نسبية أثار اتفاق التحكيم. وأن على المتعاملين في هذا المجال إدراك طبيعة الأعمال للقائمين على تنفيذها والآثار التي يمكن أن تنتج عنها وبخاصة ما قد لا يكون متوافقا مع القواعد العامة المطبقة في عقود أخرى.\nكُتب هذا المستخلص من قِبل دار المنظومة 2018
|f The study aims to illustrate the cooperation agreements in the international contracts for construction and their effect on the length of the arbitration clause. The study tackles the cooperation agreements in the international contracts for construction, what is meant by the international contracts for construction, their characteristics and their distinction. The study then refers to the meaning of the international contracts, their various types, and their characteristics. The study also reviews the most important and most common types of work, namely, the Consortium Agreements and the Joint International Project Agreement. It then discusses the scope of the arbitration clause in cooperation agreements as well as highlighting the legal nature of the Consortium agreements and the legal organization of the Consortium Agreement. The study also discusses the scope of the arbitration agreement and the reasons for its termination as well as the scope of the arbitration clause in cooperation agreements whether in the group of contracts or in the group of companies. The results of the study indicate that the special nature of the international construction contracts require that the parties' will be satisfied with the extension of the arbitration clause to the parties to the other contracts constituting the contractual group to which the arbitration clause belonged, without making it an exception to the general rule on the proportionality of the effects of the arbitration agreement.
