هدفت الدراسة إلى تحديد ماهية الحماية الجنائية للأمن والسلامة النووية، ووضع سياسة واضحة واستراتيجية فعالة للأمان النووي على الصعيد الوطني، بالإضافة إلى توضيح موقف التشريعات المقارنة للتشريع المصري والإماراتي والفرنسي من الأمان والسلامة النووي، والتعرف علي موقف المواثيق والاتفاقيات الدولية بالنسبة للأمن والسلامة النووية. واعتمدت الدراسة على المنهج المقارن. وناقشت الدراسة أهمية وجود تشريع نووي، والقواعد القانونية التي تحكم النشاط النووي والإشعاعي في مصر. كما سلطت الدراسة الضوء على ماهية الحماية الجنائية للأمن والسلامة النووية، وما المقصود بالمواد النووية. والشروط الواجب توافرها في العاملين بالمنشآت النووية، وكذلك الشروط الواجب توافرها في المنشآت الإشعاعية أو النووية. كما تناولت ماهية الإجراءات الواجب توافرها للحصول على الأمان الإشعاعي. وموقف التشريعين المصري والإماراتي من الحماية الجنائية للأمن والسلامة النووية. كماعرضت الدراسة وسائل السلامة والأمان للمنشآت النووية في فرنسا. وأكدت الدراسة على أهمية دور الوكالة الدولية للطاقة الذرية في صياغة إرشادات شاملة حول الأمن والسلامة النووية والإشعاعية بالتشاور مع الدول الأعضاء. وأوصت الدراسة بضرورة منح الجهات الرقابية الوطنية سلطات كبيرة سواء في مجال إصدار اللوائح أو في مجال رقابة الأنشطة النووية والإشعاعية. كُتب هذا المستخلص من قِبل دار المنظومة 2018
The study aimed at determining the criminal protection of the nuclear safety and security, establishing a clear policy and strategy for the nuclear safety at the national level, clarifying the position of the comparative legislation of the Egyptian, UAE and French legislations on the nuclear safety and security and identify the position of the international covenants and conventions regarding to the nuclear safety and security. The study was based on the comparative approach. The study discussed the importance of nuclear legislation and the legal rules that govern the nuclear and radiological activity in Egypt. The study also highlighted the criminal protection of the nuclear safety and security, and what the nuclear material means, as well as the conditions that must be met in the workers of the nuclear facilities, and the conditions that must to be met in the radiological or nuclear installations. It also addressed what the procedures should be available for the radiological safety and the position of the Egyptian and UAE legislatures on the criminal protection of the nuclear safety and security. The study also presented safety and security measures for the nuclear facilities in France. The study underscored the importance of the role of the International Atomic Energy Agency (IAEA) in formulating comprehensive guidance on the nuclear and radiological safety and security in the consultation with the Member States. The study recommended that the national regulators should be given great powers both in the field of issuing the regulations and in the field of the nuclear activities and radiation control.
